4. Payments and Refunds

Pricing for all products and services is clearly disclosed at checkout prior to purchase. All one-time payments are processed at the time of purchase. Unless explicitly stated otherwise, all one-time product sales are non-refundable.
Additional products may be offered following your initial purchase via a one-click upsell. Any such offer will clearly display the product description and price prior to completing the transaction. By clicking to accept any such offer, you authorise us to charge the displayed amount to your payment method immediately.
4.1 Buy Now Pay Later (BNPL)
We, 535 LLC DBA Uncle Rommy may offer Buy Now Pay Later payment options on any of our products or services, regardless of price point. This includes low-ticket, mid-tier, high-ticket, and any future offerings. BNPL options may be offered at checkout at our sole discretion and availability may vary by product, region, and provider.
Where a BNPL option is selected, you agree to the following:
Your financing agreement is entered into directly with the third-party BNPL provider (including but not limited to Clarity Pay) and is governed exclusively by that provider's own terms, conditions, and policies. 535 LLC DBA Uncle Rommy are not a party to that financing agreement and bear no responsibility for its terms, interest charges, fees, repayment schedules, or collection practices.
Our no-refund policy applies in full regardless of the payment method selected, including BNPL. Selecting a BNPL payment option does not alter, waive, or modify your obligations under these Terms in any way.
All outstanding instalments remain your sole financial responsibility and will not be cancelled, paused, reduced, or forgiven under any circumstances, including but not limited to: a dispute or chargeback initiated by you; your dissatisfaction with the product or service; revocation of your access to our products, services, or community for any reason; or the discontinuation of any product or service by 535 LLC DBA Uncle Rommy.
By selecting a BNPL payment option at checkout, you confirm that you have read and understood these Terms, that you accept full responsibility for all instalment payments due to the BNPL provider, and that you acknowledge 535 LLC DBA Uncle Rommy bear no liability in connection with your financing arrangement.

5. Community Membership and Recurring Billing
5.1 Community Access 535 LLC DBA Uncle Rommy offers an optional paid community membership. Upon subscribing, you will receive access to a private Discord server operated under the 535 LLC DBA Uncle Rommy brand. Access is contingent on maintaining an active subscription and compliance with these Terms.
5.2 Recurring Billing and Auto-Renewal By purchasing a community membership you agree that your subscription will begin immediately upon purchase and will auto-renew at the end of each billing cycle at the then-current rate. The billing amount and frequency will be clearly disclosed to you at checkout prior to purchase. You authorise us to charge your payment method on a recurring basis until you cancel. You will receive a reminder before any renewal charge where required by applicable law.
5.3 Cancellation You may cancel your community membership at any time by contacting us at [email protected] with the subject line "CANCEL MEMBERSHIP" before your next billing date. Cancellation will take effect at the end of your current billing period. You will not be charged after cancellation takes effect, but no partial refunds will be issued for unused time within a billing cycle.
5.4 Access Upon Cancellation or Non-Payment Upon cancellation or failed payment, your access to the community will be revoked at the end of the paid billing period. We reserve the right to remove access immediately in the event of a chargeback, fraudulent payment, or violation of these Terms.
5.5 Price Changes We reserve the right to change the subscription price at any time. We will provide at least 14 days' written notice by email before any price change takes effect. Continued use of the community after the price change constitutes your acceptance of the new rate. If you do not agree, you may cancel before the change takes effect.
6. Discord Community — Third-Party Platform
6.1 Third-Party Platform Disclaimer The 535 LLC DBA Uncle Rommy community is hosted on Discord, a third-party platform operated by Discord Inc. Your use of Discord is subject to Discord's own Terms of Service (discord.com/terms) and Privacy Policy (discord.com/privacy). We do not control Discord's platform, features, availability, data practices, or policies. We are not responsible for any changes Discord makes to its service, pricing, or terms.
6.2 No Liability for Platform Availability 535 LLC DBA Uncle Rommy is not liable for any interruption, suspension, or discontinuation of the Discord platform. If Discord becomes unavailable, we will make reasonable efforts to migrate the community to an alternative platform, but we do not guarantee uninterrupted access.
6.3 User-Generated Content By participating in the community, you agree that you are solely responsible for any content, messages, or media you post. You will not post content that is unlawful, defamatory, harassing, abusive, discriminatory, sexually explicit, or otherwise objectionable. You will not share or redistribute 535 LLC DBA Uncle Rommy programme content or proprietary materials without consent. You will not solicit or promote third-party products or services within the community without prior written permission.
6.4 Content Storage and Data By posting in the community, you acknowledge that Discord stores your messages, media, and activity data on its own servers in accordance with its Privacy Policy. 535 LLC DBA Uncle Rommy does not control, own, or take responsibility for how Discord stores, processes, or uses your content or data. To the fullest extent permitted by law, 535 LLC DBA Uncle Rommy accepts no liability for the storage, loss, exposure, or misuse of any content or personal data that occurs within the Discord platform.
6.5 Community Rules and Removal 535 LLC DBA Uncle Rommy reserves the right to remove any member from the community at any time, with or without notice, for any violation of these Terms or conduct we deem detrimental to the community. Removal does not entitle you to a refund of any subscription fees paid.
7. SMS Communications 535 LLC DBA Uncle Rommy — Coaching & Offer Updates. By providing your phone number and agreeing to our consent terms, you agree to receive SMS messages from 535 LLC DBA Uncle Rommy. These messages may include coaching tips, programme updates, and promotional offers. Message frequency varies. You can cancel SMS messages at any time by replying STOP. For help, reply HELP or email [email protected]. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply. 8. Limitation of Liability To the fullest extent permitted by law, 535 LLC DBA Uncle Rommy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to access our products or services; your participation in the Discord community; any content posted by you or other members in the community; any changes, suspension, or discontinuation of the Discord platform or any third-party service we use; or any matters relating to a third-party BNPL financing arrangement entered into in connection with a purchase from us. Our total liability to you for any claim shall not exceed the amount you paid directly to us in the 30 days prior to the claim arising, excluding any amounts paid to a third-party BNPL provider.
9. Indemnification You agree to indemnify and hold 535 LLC DBA Uncle Rommy harmless from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of our services, any content you post in the community, your violation of these Terms, your violation of any third-party rights, or any dispute arising from a BNPL financing arrangement you entered into in connection with a purchase from us.
10. Governing Law These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law provisions.
11. Changes to These Terms We may update these Terms from time to time. Material changes will be communicated by email or by posting a notice on our platforms. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
